doTERRA (“Company”) actively supports the advertising and promotion of its products and brand through materials provided by the Company at no or nominal cost to Wellness Advocates and Professional Account holders (collectively “Reseller”). Resellers expend extensive time, effort and resources to deliver exceptional customer service on a one on one basis. Company has unilaterally adopted this minimum advertised pricing policy (“MAP”) that shall apply to marketing of the Company’s MAP Designated Products. A Map Designated Product shall be any product listed on the Company’s web site, www.doterra.com, as it may be amended from time to time in the Company’s sole discretion. Resellers’ decisions to comply with the MAP Policy and pricing is at their sole discretion and each is free independently to decide whether or not to comply with this Policy.
MAP pricing is established by the Company for all MAP Designated Products and may be adjusted by the Company from time to time in its sole discretion. You may contact the Company’s Member Protection Team for the current MAP pricing. The inclusion in advertising of free or discounted products with a product covered by the MAP policy would be contrary to the policy if it has the effect of discounting the advertised price of the covered product below MAP.
The MAP Policy applies to all advertisements of MAP Designated Products in any and all media, including, without limitation, flyers, posters, coupons, mailers, inserts, newspapers, magazines, catalogs, mail order catalogs, Internet or similar electronic media, television, radio, and public signage. This MAP policy also applies to any activity which Company determines, in its sole discretion, is designed or intended to circumvent the intent of this MAP Policy. The MAP Policy does not apply to advertising that is not distributed to customers or advertising that is not viewable by the general public, such as advertising in a Wellness Advocate class in their home.
From time to time the Company may discontinue products or engage in promotions with respect to certain products. In such events, the Company reserves the right, in its sole discretion, to modify, suspend or terminate the MAP with respect to some or all of the affected products upon fourteen (14) days advance notification on the Company’s website of such change.
Although the decision to comply with the MAP Policy is up to the Reseller, failure to abide by this Policy will result in discipline and may include but is not limited to, canceling pending orders, restriction on future orders, and discontinuing doing business with Reseller. The Company’s Member Protection Team is responsible for determining whether a violation of this Policy has occurred. The Company does not intend to do business with Resellers who degrade the image of the Company and its products. The Company will provide notice when taking any action under this MAP Policy.
The only Company representative authorized to answer questions regarding this MAP Policy is the Company’s Member Protection Team.
The Company has established this MAP policy to help ensure the legacy of the Company as a top producer of high quality products and to protect the reputation of its name and products. The MAP policy is also designed to ensure Resellers have the incentive to devote resources into services for customers.
Company reserves the right and sole discretion at any time to modify, suspend, discontinue or enforce the MAP policy in whole or in part and no Reseller has any right to rely on the continued existence of this MAP policy or any effort by Company to enforce it. Any amendments to this Policy shall become effective thirty (30) days after the amendment is posted on the Company’s website.
